Comments on the regulation of teleworking in Spain and brief notes on compa-

rative European law

Resumen: Con motivo de la crisis sanitaria Covid-19, el ámbito de las relaciones laborales

se ha visto modificado recientemente con la instauración de nuevas formas de organización

del trabajo en la Empresa que permitan, por un lado, continuar con la actividad empresarial,

y por otro, garantizar la salud de las personas trabajadoras. Sin lugar a dudas, una de estas

principales novedades es la implementación del teletrabajo. Si bien, la veloz adaptación a la que

han tenido que hacer frente las Empresas, se enfrentaba a la ausencia total de regulación del

trabajo a distancia no solo en España, sino en la gran mayoría de países europeos, provocando

la premura de algunos Gobiernos en elaborar y aprobar una ley de teletrabajo que permitiera

otorgar seguridad jurídica.

El objetivo es analizar tanto los principales cambios producidos durante los últimos meses en el

marco legislativo nacional y de derecho comparado en materia de teletrabajo, como su incidencia

a futuro, sin olvidar la necesidad a la que se enfrentan las organizaciones y personas trabajadoras

de instaurar en su día a día buenas prácticas para el teletrabajo.

Abstract: On the occasion of the Covid-19 health crisis, the field of labour relations has recently

been modified with the establishment of new forms of work organisation in the company that

make it possible, on the one hand, to continue with business activity and, on the other, to guaran-

tee the health of workers. Without doubt, one of these main novelties is the implementation of

teleworking. Although the rapid adaptation which companies have had to face, it was confronted

with the total absence of regulation of teleworking not only in Spain, but in the great majority of

European countries, causing some governments to be in a hurry to draw up and approve a te-

lework law which would provide legal security.

The objective is analyse both the main changes that have taken place in recent months in the

national legislative and comparative law framework with regard to teleworking, and their future

impact, without forgetting the need for organisations and workers to establish good practices for

teleworking on a daily basis.
