Resumen: A través de la Sentencia objeto de estudio, el Tribunal Supremo analiza los efectos
que produce la falta de notificación del informe técnico favorable respecto del acta de replanteo
por el Ayuntamiento, cuando el mismo es exigida para el comienzo de las obras; los efectos del
silencio administrativo en tal caso y la posibilidad de incoación de un expediente de caducidad de
la licencia.
Palabras clave: Urbanismo, silencio administrativo, licencia urbanística y seguridad jurídica.
Abstract: Through the analyzed Judgement, the Supreme Court studies the effects produced by
the lack of notification of the favorable technical report regarding the rehearing act by the city
Hall, when this report is required to start the works; the effects of the administrative silence in
such case; and the possibility of initiating a license expiration record.
